SEDER & CHANDLER PARTNER OBTAINS DISMISSAL IN FEDERAL COURT FOR LACK OF JURISDICTION

Kurt Binder recently prevailed in obtaining dismissal on behalf of the firm's client, a legal marketing and advertising company, for lack of jurisdiction in the Massachusetts Federal Court. The plaintiff competitor company filed suit in Massachusetts alleging that our client, a Virginia based company, had sufficient minimum contacts in Massachusetts by virtue of its website advertising and other promotion activities. We moved to dismiss on the basis that the contacts alleged did not satisfy either the Massachusetts Long-Arm Statute or federal due process standards for imposing jurisdiction on out-of-state defendants. The Court agreed with our position and issued an 18-page decision upholding our arguments for dismissal. The holding in the case is of national significance and was the subject of a recent article in the National Law Journal in which Attorney Binder was interviewed.
